A bankruptcy judge accused two lawyers and their law firm of filing false claims that they had an interest in the company they represented during a bankruptcy. The judge said the claim was “scurrilous” and “inappropriate.”
Accusations have been made that the US Bankruptcy System is biased against debtors. The US Constitution provides for the right to a jury trial in all federal criminal cases; however, in US bankruptcy courts, there is no such right. This leaves bankrupt debtors without any real recourse or chance to fight their creditors’ claims.
